Terms of Use
These product-specific terms govern your use of CleanSwype. Review every selection and maintain any backup you need. Smart Analysis and recognized content are suggestions—not guarantees.
1. Agreement and Apple’s license
These Terms of Use (“Supplemental Terms”) are an agreement between you and Oscar Sims, an individual and the creator, owner, and operator of CleanSwype (“I,” “me,” or “my”), governing the CleanSwype iPhone and iPad application, website, and related support (the “Services”). By downloading, purchasing, accessing, or using a Service, you agree to them. If you do not agree, do not use the Services.
Unless I separately supply a custom end-user license agreement through App Store Connect, your App license is also governed by the Apple Standard Licensed Application End User License Agreement (“Apple Standard EULA”) and applicable App Store terms. These Supplemental Terms add product-specific rules and disclosures; they do not replace or reduce the Apple Standard EULA. The Apple Standard EULA or mandatory law controls any conflict.
2. Eligibility
You must have legal capacity to enter this agreement. If you have not reached legal majority where you live, a parent or legal guardian must review and agree to these Supplemental Terms and supervise your use. The Services are not directed to children under 13 or any higher minimum age required locally.
3. The Services
CleanSwype is a photo-review and organization utility. Depending on device, operating system, permissions, locale, and version, features may include swipe review; keep, delete, favorite, move, skip, and undo; Pending Deletes; Smart Analysis and collections; recognized text and codes; storage estimates; cleanup history; and privacy-oriented sharing. Features, labels, and availability may change.
4. License, ownership, and restrictions
The App is licensed, not sold. Subject to these Supplemental Terms, the Apple Standard EULA, and App Store rules, you receive a limited, personal, revocable, non-exclusive, non-transferable license to use it on Apple-branded devices you own or control and as otherwise permitted by Apple.
I and my licensors retain all rights in the Services, including software, interfaces, designs, text, graphics, logos, trademarks, and documentation. Except where law expressly permits, you may not copy, distribute, sublicense, rent, sell, publicly display, reverse engineer, decompile, extract source code, defeat technical protections, or create derivative works from the Services.
5. Your content and responsibilities
You retain ownership of photos, screenshots, text, metadata, and other material in your library (“Your Content”). I obtain no license to Your Content merely because the App processes it locally. When you direct a share or external action, you authorize your device to provide the selected material to that destination for the requested purpose.
You represent and agree that you have all rights and permissions needed to access, process, modify, share, and delete Your Content; will respect privacy, publicity, copyright, confidentiality, and other rights; will review proposed actions and preserve originals or backups where loss would matter; and will comply with law and obligations imposed by an employer, school, client, or organization.
6. Photos, iCloud, deletion, and recovery
The App requires access to permitted photo-library items. Some items may be retrieved by Apple from iCloud Photos. You are responsible for your device, Apple Account, Photos and iCloud settings, storage, connectivity, and backups. I do not control Apple services and cannot retrieve your library.
CleanSwype stages items in Pending Deletes so you can review them before requesting deletion from Apple Photos. You must confirm deletion. A confirmed action may affect every device synchronized to the same iCloud Photos library. Apple may place items in Recently Deleted, but availability, duration, synchronization, and recovery are controlled by Apple and are not guaranteed. Deletion may be permanent. Pending Deletes and Recently Deleted are not backups or archives.
7. Smart Analysis and automated output
Smart Analysis, OCR, barcode recognition, grouping, similarity detection, category labels, storage estimates, and other automated outputs are probabilistic and may be wrong, incomplete, duplicated, or unavailable. Inspect the underlying item before relying on a result or acting.
The Services are not backup, records-management, archival, forensic, security, accessibility, medical, financial, or legal services. Recognized text is not an authenticated transcription, and a collection label does not establish an image’s subject, ownership, legality, sensitivity, or importance. Never rely on CleanSwype as the sole copy of important information or the sole basis for a consequential decision.
8. Sharing, links, codes, clipboard, and maps
Share Privately attempts to remove transferable metadata from a temporary copy. It does not detect or remove all sensitive information, including faces, addresses, account numbers, reflections, screen contents, or other visible details. Metadata may be re-created by a recipient or destination. You are responsible for reviewing the copy, recipient, and destination.
Recognized links, contact details, QR codes, and map locations may be inaccurate or malicious. Opening them can send information to Apple or another party and is governed by that party’s terms and privacy policy. I do not endorse or control external content, products, transactions, security, availability, or practices. Clipboard contents may be accessible to other apps under Apple’s rules.
9. Purchases and CleanSwype Pro
Apple processes App Store purchases and governs pricing, taxes, payment methods, Family Sharing, regional availability, refunds, and transaction administration. CleanSwype does not receive your full payment-card information. Restore Purchases may require the Apple Account used for the original transaction.
Unless the App Store product page clearly states otherwise, CleanSwype Pro is a one-time, non-consumable purchase, not a recurring subscription. “Lifetime” means access to the purchased App entitlement for the commercially supported life of the CleanSwype product on compatible Apple platforms. It does not promise your lifetime, perpetual operation or updates, permanent App Store availability, compatibility with every future device or operating system, or a particular feature. Non-waivable refund, durability, conformity, and consumer rights remain unaffected.
10. Updates, compatibility, and availability
Operating-system changes, Apple policy, hardware, networks, third-party services, and technical or security requirements can affect the Services. I may update, modify, suspend, or discontinue a feature or Service for security, legal, commercial, or compatibility reasons. I do not promise permanent availability, error-free operation, or compatibility with future Apple products. Updates may be required. Mandatory consumer rights remain unaffected.
11. Acceptable use
You may not use or assist others to use the Services to violate law, regulation, court order, contract, or another person’s rights; access, alter, share, monitor, or delete content without authorization; harass, exploit, impersonate, defraud, stalk, or endanger anyone; introduce malware, overload or interfere with the Services, probe security, or bypass access or purchase controls; scrape protected portions of the Services except where law permits; or expose me, Apple, another provider, or any person to liability or harm.
12. Feedback
If you voluntarily submit ideas or feedback about the Services, you grant me a worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use, reproduce, adapt, publish, and otherwise exploit that feedback without restriction or compensation. Do not submit confidential information or material you lack the right to provide. This does not apply to Your Content sent solely to diagnose a support issue.
13. Third-party software and Apple services
The Services rely on Apple frameworks and may include third-party or open-source software governed by separate licenses. Apple Photos, iCloud Photos, StoreKit, Maps, system sharing, and external destinations are outside my direct control. Apple has no obligation to provide CleanSwype maintenance or support except as required by App Store terms or law. Contact me for App support.
14. Export and sanctions
You may not use, export, re-export, or transfer the Services except as authorized by United States law, the law where you obtained them, and other applicable trade controls. You make the restricted-country and prohibited-party representations required by applicable law and the Apple Standard EULA.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. I DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, NON-INFRINGEMENT, AVAILABILITY, SECURITY, AND DATA PRESERVATION. I DO NOT WARRANT THAT SUGGESTIONS WILL BE CORRECT, CONTENT RECOVERABLE, OR OPERATION UNINTERRUPTED OR ERROR-FREE.
Some jurisdictions do not allow certain disclaimers. Nothing here excludes a warranty, remedy, or consumer protection that cannot lawfully be excluded.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, I AND MY LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS; LOSS OF PHOTOS, DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR OPPORTUNITY; COST OF SUBSTITUTE SERVICES; OR DAMAGE ARISING FROM APPLE OR ANOTHER THIRD-PARTY SERVICE, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE. TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR CLEANSWYPE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $50.
These limits apply regardless of legal theory and are an essential allocation of risk. They do not limit liability that cannot be limited by law, which may include fraud, willful misconduct, or death or personal injury caused by negligence in some jurisdictions.
17. Indemnity for misuse
To the extent permitted by law, you will defend, indemnify, and hold me harmless from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful or intentional misuse, violation of another person’s rights, or Your Content, except to the extent caused by my breach, negligence, or misconduct. This does not apply where prohibited by consumer law.
18. Termination
You may stop using and uninstall the App at any time. Your license terminates automatically if you materially breach applicable license terms. I may suspend a Service I control when reasonably necessary for security, legal compliance, abuse prevention, or a material breach. On termination, stop using the affected Service. Ownership, feedback, disclaimers, liability limits, indemnity, and provisions that by nature should survive will continue.
19. Applicable law and disputes
The Apple Standard EULA contains governing-law provisions for the App license. Other disputes are governed by applicable law and may be brought in a court of competent jurisdiction. Nothing here removes mandatory consumer protections or access to a forum available under non-waivable law. Before filing a claim, you and I are encouraged to contact one another and try in good faith to resolve it informally.
20. General terms
- Entire agreement: these Supplemental Terms, the Apple Standard EULA, applicable App Store terms, and the Privacy Policy comprise the relevant agreement, each governing its stated subject.
- Severability: an unenforceable provision will be enforced to the maximum lawful extent or modified as little as necessary; the rest remains effective.
- No waiver: failure to enforce a provision is not a waiver.
- Assignment: you may not assign these terms without my written consent. I may assign them in a transfer or sale of the CleanSwype business or assets, or by operation of law, subject to applicable consumer law.
- Force majeure: I am not responsible for delay or failure caused by events reasonably beyond my control, including Apple-service failures, outages, disasters, labor disputes, government action, or infrastructure failures.
- Third-party beneficiaries: except for Apple and its subsidiaries to the extent provided by the Apple Standard EULA or App Store terms, these terms create no third-party beneficiary rights.
21. Changes
I may revise these Supplemental Terms for future use of the Services. I will post the new version with an updated effective date and provide additional notice or seek consent where required. Changes apply prospectively. If you do not agree to a material change, stop using the affected Service.
